Daily Five — Terms of Use

These terms are an agreement between you and FroBro Web Technologies ("we," "us") for the Daily Five app and related services ("the Service"). By creating an account or using the Service, you agree to them. If you don't agree, don't use the Service.
This is a plain-language agreement, but it is still a legal one. We've kept the boilerplate where it's needed (disclaimers, liability) and cut it everywhere else.
Who can use Daily Five
You must be at least 13 years old. If you're under the age of majority where you live, you need a parent or guardian's permission. Daily Five is not directed at children under 13, and we don't knowingly allow them to sign up.
Your account
You're responsible for keeping your sign-in credentials secure and for activity under your account. If you sign in with Apple or Google, their terms also apply to that sign-in. Tell us promptly if you believe your account has been compromised.
The Service
Daily Five helps you choose five daily habits and practice them, with an optional weekly summary sent to one person you name (your "witness"). We may add, change, or discontinue features over time. We aim for reliability but provide the Service as is (see Disclaimers).
Your content
The habits, identity statement, miss reasons, and other text you enter are yours. You grant us a limited license to store, process, and transmit that content solely to operate the Service for you — for example, to sync your data and to send your witness their weekly summary if you've set one up. We don't sell it, and we don't use it for advertising. You're responsible for the content you enter and for having the rights to it.
Your witness
If you add a witness, you confirm you have that person's permission to send them a weekly email containing your name and a summary of how you did. You can remove a witness at any time in the app, and their emails stop immediately. You are responsible for your relationship with the person you name.
Acceptable use
Don't use the Service to break the law, infringe others' rights, or send unwanted email to a "witness" who hasn't agreed to receive it. Don't attempt to disrupt, reverse-engineer, scrape, or gain unauthorized access to the Service or other users' data.
Third-party services
The Service relies on providers including Supabase (hosting, authentication), Resend (email delivery), Sentry (crash diagnostics), and Apple and Google (sign-in, app distribution). Your use may also be subject to their terms. We're not responsible for third-party services we don't control.
Not professional advice
Daily Five is a tool for personal habit-building. It is not medical, mental health, legal, financial, or other professional advice, and it is not a medical device. Use your own judgment, and consult a qualified professional for those needs.
Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that data will never be lost. You're responsible for keeping your own copies of anything important to you.
Limitation of liability
To the fullest extent permitted by law, FroBro Web Technologies will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim (which, for a free app, may be zero) or USD $50. Some jurisdictions don't allow these limits, so some may not apply to you.
Termination
You can stop using the Service and delete your account at any time in Settings → Delete account (or via our web deletion page if you've removed the app). We may suspend or terminate accounts that violate these terms or that we're required to act on by law. Deletion follows the 30-day grace period described in our Privacy Policy.
Changes to these terms
We may update these terms. If we make material changes, we'll update this page and, where appropriate, notify you in the app or by email. Continuing to use the Service after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Nevada, USA, without regard to its conflict-of-laws rules.
